Od kilku lat Polska wymaga od cudzoziemców aplikujących o status rezydenta długoterminowego państwowego certyfikatu znajomości języka polskiego. O dostęp do odpowiedniego egzaminu i wcześniej było niełatwo, ale z nadejściem COVID-19 sytuacja stała się katastrofalna.

Źle się czujesz z powodu trzeciego lockdownu? Masz prawo. Ale mogło być gorzej, gdybyś na przykład był cudzoziemcem. Bo obok wszystkich swoich problemów miałbyś na karku jeszcze kilka potyczek z polską biurokracją, od której nie sposób uciec.
Od roku 2014/2015 Polska odnotowuje rekordowy wzrost liczby imigrantów. Ponad 450 tysięcy cudzoziemców, w tym 250 tysięcy Ukraińców, posiada polskie zezwolenie na pobyt, a GUS szacuje łączną liczbę cudzoziemców w kraju na 2 miliony. Rząd chwali się nawet, że 700 tysięcy migrantów dokłada się do polskich emerytur w ZUS-ie. Sam jednak nie spieszy się z wywiązywaniem ze swoich obowiązków wobec cudzoziemców.
<h3>Wymagające państwo</h3>
O tym, jak nieudolna jest polska biurokracja wobec rosnącej od lat imigracji, zaświadczają eksperci i dziennikarze. W 2019 roku po audycie wojewódzkich wydziałów ds. cudzoziemców NIK opublikowała raport pt. Państwo niegotowe na cudzoziemców. Można w nim przeczytać m.in. o rocznych (!) kolejkach po zezwolenie na zamieszkanie (według kodeksu procedura powinna trwać 60 dni), słabo argumentowanych odmowach i generalnie mało życzliwym stosunku administracji do nowych mieszkańców kraju. Którzy, dodajmy, by dostać zezwolenie na pobyt, mają potwierdzić, że płacą podatki i składkę ZUS.
Od roku 2018 Polska wymaga też od migrantów, którzy starają się o status rezydenta długoterminowego UE – jedyną formę długotrwałej legalizacji pobytu w Polsce dla tych cudzoziemców, którzy nie mają partnera obywatela UE lub Karty Polaka – państwowego certyfikatu znajomości języka polskiego jako obcego. Eksperci krytykowali tę nowelizację: egzamin przyjmują tylko pojedyncze, uprawnione przez MEiN ośrodki (obecnie 44 placówki na cały kraj mają odpowiednie uprawnienia, ale tylko 29 można uznać za aktywnie działające), cudzoziemcy pracujący w zawodach niewymagających wysokich kwalifikacji mają bardzo ograniczoną możliwość nauki języka, a poza tym uzyskanie statusu rezydenta nie wiąże się z nabyciem praw politycznych.
Wówczas o status rezydenta co roku ubiegało się zaledwie kilka tysięcy osób, ponieważ poza znajomością języka trzeba było udokumentować aż pięć lat nieprzerwanego płacenia podatków i ZUS. Można jednak było przewidzieć, że po nasileniu się imigracji z Ukrainy w latach 2014/2015 i na początku lat 20. o status rezydenta będą się chciałyby ubiegać nawet dziesiątki tysięcy osób rocznie. Tymczasem egzamin na certyfikat jest organizowany najwyżej cztery razy w roku, a jeden ośrodek językowy może przyjąć około 100 osób. Sytuacja wyglądała zatem średnio ciekawie jeszcze przed COVID-em.
Za to od marca ubiegłego roku obserwujemy już prawdziwy dramat. Sesja czerwcowa w 2020 roku została w całości odwołana. Sesja październikowa z kolei odbyła się tylko w nielicznych ośrodkach, ponieważ dwa dni przed początkiem egzaminu cały kraj został ogłoszony czerwoną strefą, a ministerstwo nie potrafiło się odpowiednio szybko ustosunkować do kwestii, czy egzamin językowy jest zgromadzeniem publicznym.
<h3>Zapłać ZUS, nawet jeśli nie pracujesz</h3>
Egzamin stał się zatem towarem deficytowym – cudzoziemcy są często zmuszeni do rezerwacji terminów poza miejscem zamieszkania. O odwołaniu sesji październikowej niektórzy dowiadywali się już w drodze, w pociągu ze Szczecina do Rzeszowa czy z Gdańska do Katowic. W lepszych przypadkach rezerwacje były przenoszone na następną sesję, w gorszych – w całości odwoływane. Ludzie tracili więc czas, nerwy i pieniądze.
Najgorsza jest w tym wszystkim niepewność – jeżeli nie teraz, to kiedy nareszcie będę mógł to ogarnąć? Jak długo jeszcze będę mieszkał w kraju, który stał się już moim domem, ze statusem tymczasowym, pozbawiony prawa do jakiejkolwiek pomocy społecznej czy banalnego prawa pójścia na bezrobocie na kilka miesięcy (bo wszystkich tych praw cudzoziemcy z czasowym pobytem są pozbawieni)?
O kasę ostatnio też nie jest łatwo. Zwłaszcza tym, którzy pracują w hotelarstwie, gastronomii, ośrodkach sportowych – a to spory odsetek migrantów. Wielu z nich od roku jest bez pracy, ale dalej płaci ZUS po to, by nie zepsuć sobie „historii” do wniosku o status rezydenta. Bo Polska owszem, pozwoliła zostać w kraju wszystkim cudzoziemcom na czas epidemii, a utrata pracy już nie prowadzi do deportacji, ale dalej przekreśla możliwość długotrwałej legalizacji pobytu. Czyli znów kolejki i znów niepewność.
Dodajmy, że sam egzamin kosztuje 170 euro, ale do tego dochodzi opłata dla pośredników – gdy paręnaście tysięcy ludzi poluje na kilkaset miejsc, to szansę mają tylko najbardziej „przedsiębiorczy”.
Niedobra sytuacja jest również w samych ośrodkach egzaminacyjnych: reguły sanitarne wymagają zatrudnienia dodatkowej liczby personelu (sprzątanie, dezynfekcja, szatnia…) i wynajęcia dodatkowych pomieszczeń. Jeżeli zaś egzamin jest odwoływany w ostatnim momencie, to koszty ponosi ośrodek, nie państwo. Do tego pracownicy ośrodków odbierają rozpaczliwe telefony i słuchają opowieści o tym, jak ktoś już czwarty raz nie może przystąpić do egzaminu, że znów musi wyrabiać pobyt czasowy, że znów czekają go lata oczekiwania, że to nigdy się nie skończy…
<h3>Chodzi o zaufanie</h3>
Styczniowa sesja odbyła się w bardziej spokojnej atmosferze. Kolejny egzamin był wyznaczony na 27–28 marca, ale 19 marca wieczorem do sieci przedostała się informacja (koordynatorka jednego z ośrodków jest członkinią państwowej komisji certyfikacyjnej), że egzamin jednak się nie odbędzie. Podobno (!) został przeniesiony na początek maja.
Chociaż rozporządzenie rządu z dnia 19 marca 2021 roku wyraźnie pozwala na organizację egzaminu nawet w warunkach lockdownu, zgodę wycofała sama państwowa komisja ds. poświadczenia znajomości języka polskiego – półtorej godziny po publikacji rozporządzenia rządowego i tydzień przed egzaminem. Komunikat wisi na stronie komisji, natomiast liczne ośrodki ciągle nawet nie dostały oficjalnego maila czy telefonu z tak ważną przecież informacją. Cudzoziemcy już opłacili egzamin, bilety, wynajęli mieszkania, ale nikogo to nie obchodzi.
Warto podkreślić, że w obecnej sytuacji cierpią nie tylko „zwykli migranci”, ale i faworyci polskiej polityki migracyjnej – posiadacze Karty Polaka. Bez certyfikatu językowego oni również nie mogą ubiegać się o obywatelstwo. A to z kolei powoduje brak możliwości pracy w pewnych zawodach, podjęcia pracy w innym państwie UE czy wzięcia ślubu z obywatelem RP bez procesu sądowego.
Problem z egzaminem dla cudzoziemców polskiej administracji jest dobrze znany. Nad tą kwestią w ubiegłym roku pochylały się organizacje pozarządowe, interpelację wystosował Rzecznik Praw Obywatelskich. Niestety, nie doprowadziło to do uwrażliwienia administracji państwa na problemy tych, którzy w Polsce mają mniej praw niż inni, za to więcej obowiązków. A teraz dodatkowo cierpią przez niepewność covidowych czasów. Jest to kolejna ilustracja tego, w jaki sposób państwo polskie traktuje migrantów: macie pracować, płacić podatki i ZUS, inwestować u nas wasze oszczędności, ale my wam nic nie jesteśmy winni. I nawet jeśli sami stawiamy wam wymogi – to później możemy pozbawić was możliwości sprostania im.
Na początku pierwszej dekady tego wieku Polska podkreślała, że nie potrzebuje imigrantów: wysokie bezrobocie wypychało raczej rodaków z kraju na Zachód. Już niecałe dziesięć lat później stało się jednak oczywiste, że gospodarka polska po masowych wyjazdach obywateli na Wyspy i do Skandynawii jednak potrzebuje przynajmniej sezonowej siły roboczej z zagranicy. Dzisiaj demografia nie pozostawia już żadnych złudzeń: w interesie Polski leży długotrwała migracja co najmniej kilku milionów osób.
W 2020 roku w Polsce zmarło ponad 476 tysięcy osób, czyli najwięcej od drugiej wojny światowej, a urodziło się około 355 tysięcy osób, czyli najmniej od kilkunastu lat. W ciągu roku ubyło więc ponad 120 tysięcy Polaków. Wszystko wskazuje na to, że w najbliższych latach sytuacja się tylko pogorszy. Jednocześnie Polska od pięciu lat nie ma polityki migracyjnej.
Opisana wyżej sytuacja z egzaminem powoduje spadek zaufania do państwa polskiego u znacznej liczby cudzoziemców. I skłania do refleksji: a czym tak naprawdę Polska różni się od naszych krajów ojczystych?

Polska kolejny raz oblała egzamin z polityki migracyjnej

Polska polityka migracyjna i obowiązkowe egzaminy językowe dla ubiegających się o status rezydenta długoterminowego to katastrofa.

For several years Poland has required foreigners to provide a state certificate of proficiency in Polish to become long-term residents. Access to the appropriate exam before was not easy, but with the onset of Covid-19 the situation has become disastrous. This begs the question: it really worth remaining in Poland as a foreigner?

The third lockdown is getting you down? You're entitled to feel like this. Although it could be worse. You could be, for example, a foreigner in Poland. In addition to all the pandemic-related problems, you would also have to deal with the unrelenting machine of Polish bureaucracy, from which you cannot escape.
Since around 2014/2015, Poland has seen a record increase in the number of immigrants. More than 450,000 foreigners, including 250,000 Ukrainians, hold Polish residence permits. The Central Statistical Office estimates the total number of foreigners in the country at 2 million. The government even boasts that 700,000 migrants contribute to Polish pensions in the Social Insurance Institution (ZUS). However, the government itself is in no hurry to fulfil its obligations towards foreigners.
<h3>A demanding state</h3>
Experts and journalists show how inept Polish bureaucracy is in the face of immigration, despite the number of migrants increasing for years. In 2019, after an audit of regional departments for foreigners, the Supreme Audit Office (NIK) published a report entitled: "State not ready for foreigners". In the document, one can read about year-long (!) queues for residence permits (according to the law the procedure should take 60 days), poorly argued refusals, and the generally unkind attitude of the administration towards new residents of the country, among other things. It should be added that these new residents also have to confirm that they pay taxes and make social security contributions in order to get their residence permit.
The only form of long-term residence in Poland for foreigners who do not have a partner who is an EU citizen or a Pole's Card, a document confirming belonging to the Polish nation, is the EU long-term resident status. As of 2018, Poland requires migrants who apply for it to have a state certificate of knowledge of Polish as a foreign language. Experts criticised the amendment: the examination is accepted only by a few centres authorised by the Ministry of the Interior and Administration (currently 44 centres in the whole country are authorised, but only 29 are recognised as actively operating); foreigners working in jobs that do not require high level qualifications have very limited opportunities to learn the language; and moreover obtaining the status of a resident does not mean acquiring political rights.
At that early stage, only a few thousand people applied for resident status each year because, in addition to language skills, they had to prove five years of uninterrupted tax and social security payments. However, it could have been predicted that after the increase in immigration from Ukraine in 2014/2015 and the early 2020s, tens of thousands of people a year would want to apply for resident status. Yet, the exam for the language certificate is organised no more than four times a year, and one centre can only accept about 100 people. This shows that the situation was far from perfect even before Covid-19.
Since March last year, however, we have been observing a real drama. Language exams supposed to take place in June 2020 have been cancelled. The October exam session was held only in a handful of centres because two days before the start of the exam, the entire country was declared a red zone and the ministry was unable to officially determine whether a language exam counted as a public gathering in time [editor's note: public gatherings in the red zones are banned].
<h3>Pay tax, even if you don't work</h3>
The exam has therefore become a scarce commodity: foreigners are often forced to book appointments away from home. Some people found out about the cancellation of the October exam session already on their way to the examination centre, having had to travel hundreds of miles. Some were lucky: their reservations were moved to the next session, but in the worse cases they were cancelled altogether. People have paid in time and money, but it has also taken an emotional toll.
The worst thing in all this is the uncertainty: if not now, when will I finally be able to take care of it? How long will I live in the country that has already become my home, with temporary status, deprived of any social assistance or the simple right to register as unemployed?
It has not been easy to get money lately either. Especially for those who work in the hospitality sector or in sports centres, where a large percentage of migrants in Poland work. Many of them have been unemployed for a year, but continue to pay social security in order not to spoil their "record" for the application for a resident status. Poland has allowed all foreigners to stay in the country for the duration of the pandemic, and the loss of work no longer leads to deportation, but still excludes the possibility of a long-term legalisation of their stay. So again, queues and uncertainty.
Let's not to forget to mention that the exam itself costs 170 euros, but there is also a fee for intermediaries: when several thousand people are hunting for several hundred places, only the most "resourceful" stand a chance.
The situation in the examination centres requires attention as well: sanitary rules oblige them to hire additional personnel (for cleaning, disinfection, cloakroom...) and renting additional rooms. And if the exam is cancelled at the 11th hour, it is the centre that bears the costs, not the state. The centres' employees receive desperate phone calls and listen to stories about how someone cannot take the exam for the fourth time, that he or she has to obtain a temporary residence permit again, that he or she has to wait for years again, and that it will never end...
<h3>It's about trust</h3>
The January session was held in a more relaxed atmosphere. The next exam was scheduled for 27-28 March, but on the evening of 19 March the announcement that the exam will not take place went viral (the coordinator of one of the centres is a member of the state certification commission). Supposedly (!) it has been moved to the beginning of May.
Although the government regulation of 19 March 2021 explicitly allows for the exam to be organised even in lockdown conditions, the consent was withdrawn by the State Commission for the Certification of Proficiency in Polish an hour and a half after the publication of the new government regulations and a week before the exam. The announcement remains on the commission's website, but many centres still haven't received an official e-mail or phone call with this important information. People have already paid for their exams, tickets and rented apartments, but nobody cares.
It is worth stressing that in the current situation not only "ordinary migrants" suffer, but also the favourites of the Polish migration policy: the holders of the Pole's Card. Without a language certificate they cannot apply for citizenship. This, in turn, makes it impossible to work in certain professions, take up a job in another EU country or marry a Polish citizen without a court trial.
The problem of the exam for foreigners is well known to the Polish administration. Last year, this issue was discussed by NGO's and the Ombudsman sent an appeal in this regard. Unfortunately, this did not sensitise the state administration to the problems of those who have fewer rights but more obligations. And now they are additionally suffering from the uncertainty of the pandemic. This is yet another illustration of how the Polish state treats migrants: you are supposed to work, pay taxes and social security, invest your savings, but we owe you nothing. And even if we make demands of you, we may later deprive you of the opportunity to meet them.
At the beginning of the first decade of this century, Poland emphasised that it did not need immigrants. The tendency was rather the opposite: high unemployment forced Poles to go look for jobs in the West. Less than a decade later, however, it became obvious that the Polish economy, after the mass departures of citizens to Britain and Scandinavia, still needs at least a seasonal workforce from abroad. Today, due to demography, there is no doubt: long-term immigration of at least several million people is in Poland's interest.
In 2020, more than 476,000 people died in Poland, which is the highest number since World War II, and about 355,000 people were born, which is the lowest number in several years. Over the course of the last 12 months, the nation has shrunk by 120,000 people. Everything indicates that the situation will only get worse in the coming years. At the same time Poland has not had a migration policy for five years.
The situation described above with the exams is causing a decrease in confidence in the Polish state among a considerable number of foreign residents. And one has to ponder: how different is Poland really from my home country?

Poland Has Failed in Migration Policy Once Again

Poland's migration policy and the compulsory language examinations for applicants for long-term resident status are a disaster

Desde hace varios años, Polonia exige a los extranjeros un certificado de dominio del polaco para convertirse en residentes permanentes. Acceder a este examen no era fácil, pero con la llegada del covid-19 la situación se ha vuelto desastrosa. ¿Vale la pena vivir como extranjero en Polonia? 

¿Te sientes mal por vivir una nueva cuarentena? Tienes derecho a sentirte así. Pero podría ser peor. Podrías ser, por ejemplo, un extranjero en Polonia. Además de todos tus problemas, tendrías que pasar por unos cuantos choques con la implacable burocracia polaca de la que no puedes escapar.
Desde 2014 más o menos, Polonia ha experimentado un aumento récord en el número de inmigrantes. Más de 450.000 extranjeros, entre ellos 250.000 ucranianos, tienen permiso de residencia en este país. La Oficina Central de Estadística estima que el número total de extranjeros en el país es de 2 millones. El gobierno incluso se jacta de que 700.000 inmigrantes cotizan a las pensiones polacas en el Instituto de la Seguridad Social (ZUS). Pero es este mismo gobierno a quien no le corre prisa por cumplir sus obligaciones con las personas migrantes.&nbsp;
<h3>Un Estado exigente</h3>
Expertos y periodistas muestran la ineptitud de la burocracia polaca ante la inmigración, a pesar de que el número de migrantes aumenta desde hace años. En 2019, tras una auditoría de los departamentos regionales de extranjería, la Oficina Suprema de Auditoría (NIK) publicó un informe titulado: "El Estado no está preparado para los extranjeros". Entre otras cosas, el documento habla de colas de un año (¡!) para obtener el permiso de residencia. Según la ley, este procedimiento debería durar 60 días. También se mencionan denegaciones mal argumentadas y la actitud generalmente poco amable de la administración hacia los nuevos residentes del país, que deben confirmar que pagan impuestos y cotizan a la seguridad social para obtener un permiso de residencia.
La única forma de residencia de larga duración en Polonia para los extranjeros que no tienen una pareja que sea ciudadano de la Unión Europea o DNI polaco (que no se equipara con la nacionalidad, a diferencia de España) es el estatus de residente de larga duración de la Unión. Desde 2018, Polonia exige a los inmigrantes que lo solicitan un certificado estatal de conocimiento del polaco como lengua extranjera. Los expertos criticaron la enmienda porque es un examen que solo puede realizarse en unos pocos centros autorizados por el Ministerio del Interior y de la Administración. Actualmente hay 44 centros autorizados en todo el país, pero solo 29 están en activo. Los migrantes que trabajan en empleos no cualificados tienen muy pocas oportunidades de aprender el idioma; y, además, la obtención del estatus de residente no supone la adquisición de derechos políticos.
En esa primera etapa, solo unos pocos miles de personas solicitaban el estatuto de residente cada año porque, además de los conocimientos lingüísticos, tenían que demostrar cinco años de pagos ininterrumpidos de impuestos y seguridad social. Sin embargo, se podía prever que, tras el aumento de la inmigración procedente de Ucrania entre 2014 y 2015 y a principios de 2020, decenas de miles de personas al año querrían solicitar el estatus de residente. Pero el examen para el certificado de idiomas se organiza como máximo cuatro veces al año, y un centro solo puede aceptar a unas 100 personas. Esto demuestra que la situación distaba mucho de ser perfecta incluso antes del covid-19.
Desde marzo del año pasado estamos asistiendo a un auténtico drama. Los exámenes de idiomas que debían celebrarse en junio de 2020 han sido cancelados. La convocatoria de octubre solo se celebró en un puñado de centros porque dos días antes del comienzo del examen, todo el país fue declarado en alerta roja y el ministerio no pudo determinar a tiempo si un examen de idiomas contaba como reunión pública, ya que estas están prohibidas.&nbsp;
<h3>Pagar impuestos, aunque no se trabaje</h3>
Por ello, el examen se ha convertido en un bien escaso: los extranjeros se ven obligados a menudo a reservar citas fuera de casa. Algunos se enteraron de la anulación de la convocatoria de octubre ya de camino al centro de examen, habiendo tenido que recorrer cientos de kilómetros. Algunos tuvieron suerte: sus reservas se movieron a la siguiente sesión, pero en los peores casos se cancelaron por completo. La gente ha pagado con tiempo y dinero, pero también hay un precio emocional detrás.
Lo peor de todo esto es la incertidumbre: si no es ahora, ¿cuándo podré ocuparme de ello? ¿Cuánto tiempo viviré en el país que ya se ha convertido en mi hogar, con un estatus temporal, privado de cualquier asistencia social o del simple derecho a inscribirme como desempleado?
Últimamente tampoco es fácil conseguir dinero. Sobre todo para quienes trabajan en el sector de la hostelería o en centros deportivos, donde trabaja un gran porcentaje de inmigrantes en Polonia. Muchos de ellos llevan un año en el paro, pero siguen pagando a la seguridad social para no estropear su "historial" de cara a la solicitud de la residencia permanente. Polonia ha permitido a todos los extranjeros seguir en el país mientras dure la pandemia, y la pérdida de trabajo ya no conlleva la deportación, pero sigue excluyendo la posibilidad de legalizar su estancia a largo plazo. Así que, de nuevo, colas e incertidumbre.
No olvidemos mencionar que el examen en sí cuesta 170 euros, pero también hay una tasa para los intermediarios: cuando varios miles de personas están a la caza de varios cientos de plazas, solo los más "ingeniosos" tienen una oportunidad.
La situación de los centros de examen también requiere atención: las normas sanitarias les obligan a contratar personal adicional (para la limpieza, desinfección, guardarropa...) y a alquilar salas adicionales. Y si el examen se anula a última hora, es el centro el que corre con los gastos, no el Estado. Los empleados de los centros reciben llamadas telefónicas desesperadas y escuchan historias sobre cómo alguien no puede presentarse al examen por cuarta vez, que tiene que volver a obtener un permiso de residencia temporal, que tiene que volver a esperar durante años, y que esto no acabará nunca...
<h3>Es cuestión de confianza</h3>
La convocatoria de enero se celebró en un ambiente más relajado. El próximo examen estaba previsto para los días 27 y 28 de marzo, pero la noche del 19 de marzo se hizo viral el anuncio de que la prueba no se celebraría. El coordinador de uno de los centros es miembro de la comisión estatal de certificación. Supuestamente, se ha trasladado a principios de mayo.
Aunque el reglamento gubernamental del 19 de marzo de 2021 permite explícitamente organizar el examen incluso en condiciones de bloqueo, la Comisión Estatal para la Certificación del Dominio del Polaco retiró el consentimiento una hora y media después de la publicación del nuevo reglamento gubernamental y una semana antes del examen. El anuncio sigue en la página web de la comisión, pero muchos centros aún no han recibido un correo electrónico oficial o una llamada telefónica con esta información. La gente ya ha pagado sus tasas de exámenes, los billetes y los pisos de alquiler, pero a nadie le importa.
Cabe destacar que en la situación actual no solo sufren los "inmigrantes de a pie", sino también los favoritos de la política migratoria polaca: los titulares de la Tarjeta Polac, el DNI mencionado más arriba que no implica nacionalidad. Sin un certificado de idioma no pueden solicitar la ciudadanía. Esto, a su vez, hace imposible trabajar en determinadas profesiones, ocupar un puesto de trabajo en otro país de la Unión o casarse con un ciudadano polaco sin un juicio.
El problema del examen para extranjeros es bien conocido por la administración polaca. El año pasado, esta cuestión fue debatida por las ONG y el Defensor del Pueblo lanzó un llamamiento al respecto. Desgraciadamente, esto no sensibilizó a la administración estatal sobre los problemas de aquellos que tienen menos derechos pero más obligaciones. Y ahora están sufriendo adicionalmente la incertidumbre de la pandemia. Este es otro ejemplo de cómo el Estado polaco trata a los inmigrantes: se supone que debéis trabajar, pagar impuestos y seguridad social, invertir vuestros ahorros, pero no os debemos nada. E incluso si os exigimos algo, luego podemos privaros de la oportunidad de cumplirlo.
A principios de los 2000, Polonia hacía hincapié en que no necesitaba inmigrantes. La tendencia era más bien la contraria: el elevado desempleo obligaba a los polacos a buscar trabajo en Occidente. Sin embargo, menos de una década después, se ha hecho evidente que la economía polaca, tras la salida masiva de ciudadanos a Gran Bretaña y Escandinavia, sigue necesitando al menos una mano de obra estacional del extranjero. Hoy, debido a la demografía, no hay duda: a Polonia le interesa una inmigración a largo plazo de al menos varios millones de personas.
En 2020, murieron en Polonia más de 476.000 personas, la cifra más alta desde la Segunda Guerra Mundial, y nacieron unas 355.000, la cifra más baja en varios años. En el transcurso de los últimos 12 meses, la población se ha reducido en 120.000 personas. Todo indica que la situación no hará más que empeorar en los próximos años. Al mismo tiempo, Polonia lleva cinco años sin política migratoria.
La situación descrita con los exámenes está provocando una disminución de la confianza en el Estado polaco entre un número considerable de residentes extranjeros. Y uno tiene que reflexionar: ¿cuán diferente es realmente Polonia de mi país de origen?

Polonia ha vuelto a fracasar en su política migratoria

La política migratoria y el sistema de exámenes para residentes permanentes están llenos de escollos

Depuis plusieurs années, la Pologne exige des étrangers qu'ils fournissent un certificat d'État de maîtrise du polonais pour devenir des résidents de longue durée. Or l'accès à l'examen, déjà difficile, est devenu impossible avec la pandémie. 

Vous vous sentez mal durant le troisième confinement ? Vous avez le droit. Mais cela pourrait être pire. Vous pourriez être, par exemple, un étranger en Pologne. En plus de tous vos problèmes, vous devriez également passer par quelques escarmouches avec l'implacable bureaucratie polonaise à laquelle vous ne pouvez pas échapper.
Depuis 2014-2015, la Pologne a connu une augmentation record du nombre d'immigrants. Plus de 450 000 étrangers, dont 250 000 Ukrainiens, détiennent un permis de séjour polonais. Le Bureau central des statistiques estime à 2 millions le nombre total d'étrangers dans le pays. Le gouvernement se vante même que 700 000 migrants contribuent aux retraites polonaises dans l'Institution d'assurance sociale (ZUS). Cependant, le gouvernement lui-même n'est pas pressé de remplir ses obligations envers les étrangers.
<h3>Un État exigeant</h3>
Experts et journalistes montrent à quel point la bureaucratie polonaise est incompétente face à l'immigration, alors que le nombre de migrants augmente depuis des années. En 2019, après un audit des départements régionaux pour les étrangers, la Cour suprême des comptes (NIK) a publié un rapport intitulé « L'État n'est pas prêt pour les étrangers ». Dans ce document, on découvre notamment les files d'attente d'un an (!) pour les permis de séjour (selon la loi, la procédure devrait prendre 60 jours), les refus mal argumentés et l'attitude généralement peu aimable de l'administration envers les nouveaux résidents du pays. Ces derniers doivent confirmer qu'ils paient des impôts et des cotisations de sécurité sociale afin d'obtenir un permis de séjour.
La seule forme de résidence à long terme en Pologne pour les étrangers qui ne sont pas en couple avec un citoyen de l'UE et ne détiennent pas de carte polonaise, que les étrangers peuvent obtenir pour vivre en Pologne, est le statut de résident à long terme de l'UE. Depuis 2018, la Pologne exige des migrants qui en font la demande un certificat d'État de connaissance du polonais comme langue étrangère. Les experts ont critiqué cet amendement : l'examen n'est accepté que par quelques centres autorisés par le ministère de l'Intérieur et de l'Administration (actuellement, 44 centres sont autorisés dans tout le pays, mais seuls 29 sont reconnus comme fonctionnant activement) ; les étrangers qui travaillent dans des emplois ne nécessitant pas de qualifications de haut niveau ont des possibilités très limitées d'apprendre la langue. De plus, l'obtention du statut de résident ne signifie pas l'acquisition de droits politiques.
À ce stade précoce, seules quelques milliers de personnes demandaient le statut de résident chaque année car, outre les compétences linguistiques, elles devaient prouver cinq années ininterrompues de paiement d'impôts et de cotisations sociales. Cependant, on aurait pu prévoir qu'après l'augmentation de l'immigration en provenance d'Ukraine en 2014-2015 et au début des années 2020, des dizaines de milliers de personnes par an voudraient demander le statut de résident. Pourtant, l'examen pour le certificat de langue n'est organisé que quatre fois par an au maximum, et un centre ne peut accepter qu'une centaine de personnes. Cela montre que la situation était loin d'être parfaite même avant l'arrivée de la Covid-19.
Or, depuis mars dernier, nous assistons à un véritable drame. Les examens de langue qui devaient avoir lieu en juin 2020 ont été annulés. La session d'examens d'octobre n'a eu lieu que dans une poignée de centres, car deux jours avant le début de l'examen, tout le pays a été déclaré zone rouge et le ministère n'a pas pu déterminer officiellement si un examen de langue comptait comme un rassemblement public à temps (les rassemblements publics dans les zones rouges sont interdits, ndlr).
<h3>Payer des impôts, même si vous ne travaillez pas</h3>
L'examen est donc devenu une denrée rare : les étrangers sont souvent obligés de prendre rendez-vous loin de chez eux. Certaines personnes ont appris l'annulation de la session d'examen d'octobre alors qu'elles étaient déjà en route vers le centre d'examen, après avoir dû parcourir des centaines de kilomètres. Certains ont eu de la chance : leurs réservations ont été reportées à la session suivante, mais dans le pire des cas, elles ont été purement et simplement annulées. Les gens ont payé en temps et en argent, mais ils ont aussi payé un lourd tribut émotionnel.
Le pire dans tout cela, c'est l'incertitude : si ce n'est pas maintenant, quand pourrai-je enfin m'en occuper ? Combien de temps vais-je vivre dans le pays qui est déjà devenu mon foyer, avec un statut temporaire, privé de toute aide sociale ou du simple droit de m'inscrire au chômage ?
Il n'a pas été facile non plus de trouver de l'argent ces derniers temps. Surtout pour ceux qui travaillent dans le secteur de l'hôtellerie et de la restauration ou dans des centres sportifs, où travaillent un grand pourcentage de migrants en Pologne. Beaucoup d'entre eux sont au chômage depuis un an, mais continuent de payer la sécurité sociale afin de ne pas gâcher leur « dossier » pour la demande de statut de résident. La Pologne a autorisé tous les étrangers à rester dans le pays pendant la durée de la pandémie. Si la perte de travail ne conduit plus à l'expulsion, elle exclut toujours la possibilité d'une légalisation à long terme de leur séjour. Résultat, les files d'attente et l'incertitude continuent.
N'oublions pas de mentionner que l'examen lui-même coûte 170 euros, mais qu'il y a aussi des frais pour les intermédiaires : lorsque plusieurs milliers de personnes sont en quête de quelques centaines de places, seuls les plus « débrouillards » ont une chance.
La situation dans les centres d'examen requiert également de l'attention : les règles sanitaires les obligent à engager du personnel supplémentaire (pour le nettoyage, la désinfection, le vestiaire...) et à louer des salles supplémentaires. Et si l'examen est annulé au dernier moment, c'est le centre qui en supporte les frais, pas l'État. Les employés des centres reçoivent des appels téléphoniques désespérés et écoutent des histoires racontant comment une personne n'a pas pu passer l'examen pour la quatrième fois, devant à nouveau obtenir un permis de séjour temporaire, soit attendre pendant des années, et que cela ne finira jamais...
<h3>C'est une question de confiance</h3>
La session de janvier s'est déroulée dans une atmosphère plus détendue. Le prochain examen était prévu les 27 et 28 mars, mais le 19 mars au soir, l'annonce de son annulation est devenue virale (le coordinateur d'un des centres est membre de la commission de certification de l'État). Il est censé (!) avoir été repoussé à début mai.
Bien que le règlement gouvernemental du 19 mars 2021 permette explicitement l'organisation de l'examen même dans des conditions de confinement, l'autorisation a été retirée par la commission pour la certification des compétences en polonais une heure et demie après la publication du nouveau règlement gouvernemental et une semaine avant l'examen. L'annonce reste sur le site web de la commission, mais de nombreux centres n'ont toujours pas reçu de courriel officiel ou d'appel téléphonique contenant cette information importante. Les gens ont déjà payé leurs examens, leurs billets et leur location d'appartement, mais tout le monde s'en fiche.
La situation actuelle ne pénalise pas seulement les « migrants ordinaires » mais aussi les favoris de la politique migratoire polonaise : les titulaires de la carte polonaise. Sans certificat de langue, ils ne peuvent pas demander la citoyenneté. Il leur est donc impossible d'exercer certaines professions, d'accepter un emploi dans un autre pays de l'UE ou d'épouser un citoyen polonais sans passer par un tribunal.
Le problème de l'examen linguistique pour les étrangers est bien connu de l'administration polonaise. L'année dernière, cette question a été discutée par des ONG et a fait l'objet d'un appel du Médiateur. Malheureusement, cela n'a pas sensibilisé l'administration aux problèmes de ceux qui ont moins de droits, mais plus d'obligations. Et voilà qu'ils souffrent en plus de l'incertitude de la pandémie. Voilà une nouvelle illustration de la façon dont l'État polonais traite les migrants : vous êtes censés travailler, payer des impôts et la sécurité sociale, investir vos économies, mais nous ne vous devons rien. Et même si nous vous imposons des exigences, nous pouvons plus tard vous priver de la possibilité de les satisfaire.
Au début de la première décennie de ce siècle, la Pologne soulignait qu'elle n'avait pas besoin d'immigrants. La tendance était plutôt inverse : le chômage élevé obligeait les Polonais à aller chercher du travail à l'Ouest. Moins d'une décennie plus tard, cependant, il est devenu évident que l'économie polonaise, après les départs massifs de citoyens vers la Grande-Bretagne et la Scandinavie, a toujours besoin au moins d'une main-d'œuvre saisonnière venue de l'étranger. Aujourd'hui, en raison de la démographie, il n'y a aucun doute : une immigration à long terme d'au minimum plusieurs millions de personnes est dans l'intérêt de la Pologne.
En 2020, plus de 476 000 personnes sont mortes en Pologne, le chiffre le plus élevé depuis la Seconde Guerre mondiale, et environ 355 000 personnes sont nées, ce qui est le chiffre le plus bas depuis plusieurs années. Au cours des 12 derniers mois, la nation a diminué de 120 000 personnes. Tout indique que la situation ne fera qu'empirer dans les années à venir. Dans le même temps, la Pologne n'a pas eu de politique migratoire depuis cinq ans.
La situation décrite ci-dessus avec les examens de langue entraîne une diminution de la confiance dans l'État polonais chez un nombre considérable de résidents étrangers. Elle les pousse à s'interroger en quoi la Pologne est vraiment différente de leur pays d'origine.

Dans la peau d'un étranger en Pologne

La Pologne exige des étrangers qu'ils travaillent et paient leurs impôts, mais ne leur fournit aucuns droits en échange.

Για αρκετά χρόνια η Πολωνία απαιτούσε από τους αλλοδαπούς να προσκομίσουν κρατικό πιστοποιητικό γνώσης της πολωνικής γλώσσας για να γίνουν επί μακρόν παραμένοντες. Η πρόσβαση στις αναγκαίες εξετάσεις πριν δεν ήταν εύκολη, αλλά με την έναρξη του Covid-19 η κατάσταση έχει γίνει καταστροφική. Αυτό εγείρει το ερώτημα: αξίζει πραγματικά να παραμείνει κανείς στην Πολωνία ως αλλοδαπός;

Αισθάνεστε άσχημα στο τρίτο lockdown; Είναι λογικό να αισθάνεστε έτσι. Αλλά θα μπορούσε να είναι και χειρότερα. Θα μπορούσατε, για παράδειγμα, να είστε ξένος στην Πολωνία. Εκτός από όλα τα άλλα προβλήματά σας, θα έπρεπε να εμπλακείτε και σε μερικές συγκρούσεις με την αδυσώπητη πολωνική γραφειοκρατία, από την οποία δεν μπορείτε να ξεφύγετε.
Από το 2014/2015 περίπου, η Πολωνία έχει σημειώσει αύξηση ρεκόρ στον αριθμό των μεταναστών. Περισσότεροι από 450.000 αλλοδαποί, συμπεριλαμβανομένων 250.000 Ουκρανών, έχουν λάβει άδειες παραμονής στην Πολωνία. Η Κεντρική Στατιστική Υπηρεσία υπολογίζει τον συνολικό αριθμό των αλλοδαπών στη χώρα σε 2 εκατομμύρια. Η κυβέρνηση μάλιστα υπερηφανεύεται ότι 700.000 μετανάστες συνεισφέρουν στις πολωνικές συντάξεις στο Ίδρυμα Κοινωνικών Ασφαλίσεων (ZUS). Ωστόσο, η ίδια η κυβέρνηση δε βιάζεται να εκπληρώσει τις υποχρεώσεις της έναντι των αλλοδαπών.
<h3>Ένα απαιτητικό κράτος</h3>
Εμπειρογνώμονες και δημοσιογράφοι δείχνουν πόσο ανίκανη είναι η πολωνική γραφειοκρατία απέναντι στη μετανάστευση, παρά το γεγονός ότι ο αριθμός των μεταναστών αυξάνεται εδώ και χρόνια. Το 2019, μετά από έλεγχο των περιφερειακών υπηρεσιών για τους αλλοδαπούς, η Ανώτατη Ελεγκτική Υπηρεσία (NIK) δημοσίευσε έκθεση με τίτλο: «Το κράτος δεν είναι έτοιμο για τους αλλοδαπούς». Στο έγγραφο, μπορεί κανείς να διαβάσει, μεταξύ άλλων, για λίστες αναμονής που φτάνουν το έτος (!) μέχρι να λάβουν άδεια παραμονής (σύμφωνα με το νόμο η διαδικασία θα έπρεπε να διαρκεί 60 ημέρες), κακώς αιτιολογημένες αρνήσεις χορήγησης και γενικά για μια καθόλου ευγενική στάση της διοίκησης απέναντι στους νέους κατοίκους της χώρας. Τους νέους κατοίκους που πρέπει να επιβεβαιώσουν ότι πληρώνουν φόρους και εισφορές κοινωνικής ασφάλισης προκειμένου να λάβουν άδεια παραμονής.
Η μόνη μορφή μακροχρόνιας διαμονής στην Πολωνία για τους αλλοδαπούς που δεν έχουν σύντροφο πολίτη της ΕΕ ή κάρτα Πολωνού, έγγραφο που επιβεβαιώνει το ανήκειν στο πολωνικό έθνος, είναι το καθεστώς του επί μακρόν διαμένοντος στην ΕΕ. Από το 2018, η Πολωνία απαιτεί από τους μετανάστες που υποβάλλουν αίτηση παραμονής να διαθέτουν κρατικό πιστοποιητικό γνώσης της πολωνικής ως ξένης γλώσσας. Οι εμπειρογνώμονες επέκριναν την τροπολογία: η εξέταση γίνεται δεκτή μόνο από λίγα κέντρα που έχουν εγκριθεί από το Υπουργείο Εσωτερικών και Διοίκησης (επί του παρόντος έχουν εγκριθεί 44 κέντρα σε ολόκληρη τη χώρα, αλλά μόνο 29 έχουν αναγνωριστεί ως εν λειτουργία), οι αλλοδαποί που εργάζονται σε θέσεις εργασίας που δεν απαιτούν υψηλά προσόντα έχουν πολύ περιορισμένες ευκαιρίες εκμάθησης της γλώσσας και επιπλέον η απόκτηση του καθεστώτος του μόνιμου κατοίκου δε σημαίνει και απόκτηση πολιτικών δικαιωμάτων.
Σε εκείνο το πρώιμο στάδιο, μόνο μερικές χιλιάδες άνθρωποι υπέβαλλαν αίτηση για καθεστώς διαμένοντα κάθε χρόνο, διότι, εκτός από τις γλωσσικές δεξιότητες, έπρεπε να μπορούν να αποδείξουν πέντε χρόνια αδιάλειπτης καταβολής φόρων και εισφορών κοινωνικής ασφάλισης. Ωστόσο, θα μπορούσε να έχει προβλεφθεί ότι μετά την αύξηση της μετανάστευσης από την Ουκρανία το 2014/2015 και στις αρχές της δεκαετίας του 2020, δεκάδες χιλιάδες άνθρωποι ετησίως πιθανόν να ήθελαν να υποβάλουν αίτηση για διαμονή. Ωστόσο, οι εξετάσεις για το πιστοποιητικό γλωσσομάθειας διοργανώνονται το πολύ τέσσερις φορές το χρόνο και ένα κέντρο μπορεί να δεχτεί μόνο περίπου 100 άτομα. Αυτό δείχνει ότι η κατάσταση δεν ήταν καθόλου τέλεια ακόμη και πριν από το Covid-19.
Από τον περασμένο Μάρτιο, ωστόσο, παρατηρούμε ένα πραγματικό δράμα. Οι εξετάσεις γλωσσικής επάρκειας που επρόκειτο να διεξαχθούν τον Ιούνιο του 2020 ακυρώθηκαν. Η εξεταστική περίοδος του Οκτωβρίου διεξήχθη μόνο σε ελάχιστα κέντρα, επειδή δύο ημέρες πριν από την έναρξη των εξετάσεων, ολόκληρη η χώρα κηρύχθηκε κόκκινη ζώνη και το υπουργείο δεν ήταν σε θέση να καθορίσει επίσημα και εγκαίρως αν οι εξετάσεις ξένων γλωσσών λογίζονται ως δημόσια συγκέντρωση [σημείωση του συντάκτη: οι δημόσιες συγκεντρώσεις στις κόκκινες ζώνες απαγορεύονται].
<h3>Πληρώστε φόρο, ακόμη και αν δεν εργάζεστε</h3>
Οι εξετάσεις έχουν επομένως γίνει ένα σπάνιο αγαθό: οι αλλοδαποί αναγκάζονται συχνά να κλείνουν ραντεβού μακριά από το σπίτι τους. Κάποιοι έμαθαν για την ακύρωση της εξεταστικής περιόδου του Οκτωβρίου ενώ ήταν καθ' οδόν προς το εξεταστικό κέντρο, αφού ήταν υποχρεωμένοι να διανύσουν εκατοντάδες χιλιόμετρα. Κάποιοι ήταν τυχεροί: οι κρατήσεις τους μεταφέρθηκαν στην επόμενη συνεδρία, αλλά στις χειρότερες περιπτώσεις ακυρώθηκαν εντελώς. Οι άνθρωποι πλήρωσαν σε χρόνο και χρήμα, αλλά αυτό είχε επίσης συναισθηματικό τίμημα.
Το χειρότερο σε όλο αυτό είναι η αβεβαιότητα: αν όχι τώρα, πότε θα μπορέσω τελικά να τα τακτοποιήσω αυτά; Πόσο καιρό θα ζω στη χώρα που έχει ήδη γίνει το σπίτι μου, με προσωρινό καθεστώς, στερούμενος κάθε κοινωνικής βοήθειας ή του απλού δικαιώματος να εγγραφώ ως άνεργος;
Το τελευταίο διάστημα μάλιστα δεν ήταν εύκολο να βγάλουν χρήματα. Ειδικά για όσους εργάζονται στον τομέα της φιλοξενίας ή σε αθλητικά κέντρα, όπου εργάζεται ένα μεγάλο ποσοστό των μεταναστών στην Πολωνία. Πολλοί από αυτούς είναι άνεργοι εδώ και ένα χρόνο, αλλά συνεχίζουν να πληρώνουν την κοινωνική ασφάλιση για να μη χαλάσουν το «μητρώο» τους για την αίτηση χορήγησης καθεστώτος κατοίκου. Η Πολωνία επέτρεψε σε όλους τους αλλοδαπούς να παραμείνουν στη χώρα κατά τη διάρκεια της πανδημίας και η απώλεια εργασίας δεν οδηγεί πλέον σε απέλαση, αλλά εξακολουθεί να αποκλείει τη δυνατότητα μακροχρόνιας νομιμοποίησης της παραμονής τους. Έτσι και πάλι, ουρές και αβεβαιότητα.
Ας μην ξεχάσουμε να αναφέρουμε ότι οι ίδιες οι εξετάσεις κοστίζουν 170 ευρώ, αλλά υπάρχει και ένα τέλος για τους μεσάζοντες: όταν πολλές χιλιάδες άνθρωποι κυνηγούν μερικές εκατοντάδες θέσεις, μόνο οι πιο «πολυμήχανοι» έχουν μια ευκαιρία.
Η κατάσταση στα εξεταστικά κέντρα απαιτεί επίσης προσοχή: οι υγειονομικοί κανόνες τα υποχρεώνουν να προσλάβουν επιπλέον προσωπικό (για την καθαριότητα, την απολύμανση, την γκαρνταρόμπα…) και να νοικιάσουν πρόσθετες αίθουσες. Και αν οι εξετάσεις ακυρωθούν την τελευταία στιγμή, το κόστος το επωμίζεται το κέντρο και όχι το κράτος. Οι υπάλληλοι των κέντρων δέχονται απελπισμένα τηλεφωνήματα και ακούνε ιστορίες για το πώς κάποιος δεν μπορεί να δώσει εξετάσεις για τέταρτη φορά, ότι πρέπει να αποκτήσει ξανά προσωρινή άδεια παραμονής, ότι πρέπει να περιμένει πάλι χρόνια και ότι αυτό δε θα τελειώσει ποτέ…
<h3>Είναι θέμα εμπιστοσύνης</h3>
Η εξέταση του Ιανουαρίου πραγματοποιήθηκε σε πιο χαλαρή ατμόσφαιρα. Οι επόμενες εξετάσεις ήταν προγραμματισμένες για τις 27-28 Μαρτίου, αλλά το βράδυ της 19ης Μαρτίου η ανακοίνωση ότι οι εξετάσεις δε θα πραγματοποιηθούν έγινε viral (ο συντονιστής ενός από τα κέντρα είναι μέλος της κρατικής επιτροπής πιστοποίησης). Υποτίθεται (!) ότι μεταφέρεται για αρχές Μαΐου.
Παρόλο που ο κυβερνητικός κανονισμός της 19ης Μαρτίου 2021 επιτρέπει ρητά τη διοργάνωση των εξετάσεων ακόμη και σε συνθήκες lockdown, η συγκατάθεση ανακλήθηκε από την Κρατική Επιτροπή Πιστοποίησης Γνώσης της Πολωνικής Γλώσσας μιάμιση ώρα μετά τη δημοσίευση των νέων κυβερνητικών κανονισμών και μια εβδομάδα πριν από τις εξετάσεις. Η ανακοίνωση παραμένει στον ιστότοπο της Επιτροπής, αλλά πολλά κέντρα δεν έχουν ακόμη λάβει επίσημο μήνυμα ηλεκτρονικού ταχυδρομείου ή τηλεφώνημα με αυτή τη σημαντική πληροφορία. Οι άνθρωποι έχουν ήδη πληρώσει για τις εξετάσεις τους, τα εισιτήρια και τα ενοικιαζόμενα διαμερίσματα, αλλά κανείς δεν ενδιαφέρεται.
Αξίζει να τονιστεί ότι στην παρούσα κατάσταση δεν υποφέρουν μόνο οι «απλοί μετανάστες», αλλά και οι ευνοούμενοι της πολωνικής μεταναστευτικής πολιτικής: οι κάτοχοι της κάρτας Πολωνού. Χωρίς πιστοποιητικό γλωσσομάθειας δεν μπορούν να υποβάλουν αίτηση για υπηκοότητα. Αυτό, με τη σειρά του, καθιστά αδύνατο να εργαστούν σε ορισμένα επαγγέλματα, να αναλάβουν εργασία σε άλλη χώρα της ΕΕ ή να παντρευτούν Πολωνό πολίτη χωρίς δικαστική διαδικασία.
Το πρόβλημα των εξετάσεων για τους αλλοδαπούς είναι γνωστό στην πολωνική κυβέρνηση. Πέρυσι, το θέμα αυτό συζητήθηκε από ΜΚΟ και ο Διαμεσολαβητής απέστειλε σχετική έκκληση. Δυστυχώς, αυτό δεν ευαισθητοποίησε την κρατική διοίκηση σχετικά με τα προβλήματα εκείνων που έχουν λιγότερα δικαιώματα αλλά περισσότερες υποχρεώσεις. Και τώρα υποφέρουν επιπλέον από την αβεβαιότητα της πανδημίας. Αυτό είναι ένα ακόμη παράδειγμα του πώς το πολωνικό κράτος αντιμετωπίζει τους μετανάστες: υποτίθεται ότι πρέπει να εργάζεστε, να πληρώνετε φόρους και κοινωνική ασφάλιση, να επενδύετε τις αποταμιεύσεις σας, αλλά εμείς δε σας χρωστάμε τίποτα. Και ακόμη και αν σας θέσουμε απαιτήσεις, μπορεί αργότερα να σας στερήσουμε την ευκαιρία να τις ικανοποιήσετε.
Στις αρχές της πρώτης δεκαετίας αυτού του αιώνα, η Πολωνία τόνιζε ότι δεν χρειαζόταν μετανάστες. Η τάση ήταν μάλλον η αντίθετη: η υψηλή ανεργία ανάγκαζε τους Πολωνούς να αναζητούν εργασία στη Δύση. Λιγότερο από μια δεκαετία αργότερα, ωστόσο, έγινε φανερό ότι η πολωνική οικονομία, μετά τις μαζικές αναχωρήσεις πολιτών προς τη Βρετανία και τη Σκανδιναβία, εξακολουθεί να χρειάζεται τουλάχιστον ένα εποχικό εργατικό δυναμικό από το εξωτερικό. Σήμερα, λόγω του δημογραφικού, δεν υπάρχει καμία αμφιβολία: η μακροπρόθεσμη μετανάστευση τουλάχιστον αρκετών εκατομμυρίων ανθρώπων είναι προς το συμφέρον της Πολωνίας.
Το 2020, περισσότεροι από 476.000 άνθρωποι πέθαναν στην Πολωνία, που είναι ο υψηλότερος αριθμός μετά τον Β' Παγκόσμιο Πόλεμο, και περίπου 355.000 άνθρωποι γεννήθηκαν, που είναι ο χαμηλότερος αριθμός εδώ και αρκετά χρόνια. Κατά τη διάρκεια των τελευταίων 12 μηνών, το έθνος συρρικνώθηκε κατά 120.000 άτομα. Όλα δείχνουν ότι η κατάσταση θα επιδεινωθεί τα επόμενα χρόνια. Παράλληλα, η Πολωνία δεν έχει μεταναστευτική πολιτική εδώ και πέντε χρόνια.
Η κατάσταση που περιγράφηκε παραπάνω με τις εξετάσεις προκαλεί μείωση της εμπιστοσύνης στο πολωνικό κράτος σε σημαντικό αριθμό ξένων κατοίκων. Και πρέπει κανείς να αναρωτηθεί: πόσο διαφορετική είναι πραγματικά η Πολωνία από την πατρίδα μου;

Seit einigen Jahren verlangt Polen von Ausländern ein staatliches Zertifikat über die Beherrschung der polnischen Sprache, wenn sie sich langfristig in Polen aufhalten wollen. Es war zwar noch nie einfach, entsprechende Prüfung machen zu können, seit Ausbruch der Pandemie hat sich die Situation jedoch noch verschärft. Da stellt sich die Frage: Lohnt es sich wirklich, als Ausländer in Polen zu bleiben?

Sind Sie genervt vom dritten Lockdown? Verständlich. Es könnte jedoch schlimmer sein. Sie könnten beispielsweise ein Ausländer in Polen sein. Dann hätten Sie nämlich auch noch mit der unerbittlichen polnischen Bürokratie zu tun, der Sie nicht entkommen könnten.
Seit etwa 2014 verzeichnet Polen einen Rekordanstieg der Zuwandererzahlen. Mehr als 450.000 Ausländer, darunter 250.000 Ukrainer, besitzen eine polnische Aufenthaltserlaubnis. Das Zentrale Statistikamt schätzt die Gesamtzahl der Ausländer im Land auf zwei Millionen. Die Regierung rühmt sich sogar, dass 700.000 Migrierende in der Sozialversicherungsanstalt (ZUS) in die polnische Rente einzahlen. Die Regierung selbst hat es jedoch nicht eilig, ihre Verpflichtungen gegenüber Ausländern zu erfüllen.
<h3>Ein anspruchsvoller Staat</h3>
Experten und Journalisten zeigen, dass die polnische Bürokratie trotz der steigenden Einwandererzahlen beim Thema der Einwanderung nichts dazugelernt hat. Im Jahr 2019 veröffentlichte der Oberste Rechnungshof (NIK) nach einer Prüfung der regionalen Ausländerbehörden einen Bericht mit dem Titel: "Staat nicht bereit für Ausländer". In dem Dokument werden unter anderem jahrelanges (!) Warten auf Aufenthaltsgenehmigungen (laut Gesetz sollte das Verfahren 60 Tage dauern), schlecht begründete Ablehnungen und das allgemein unfreundliche Verhalten der Behörden gegenüber Neuankömmlingen erwähnt. Die neuen Einwohner müssen beweisen, dass sie Steuern und Sozialversicherungsbeiträge zahlen, um eine Aufenthaltsgenehmigung zu bekommen.
Für diejenigen, die keinen Partner aus der EU haben und keine "Karta Polaka" besitzen, eine Art polnische Green Card, die die polnische Staatsangehörtigkeit bestätigt, ist eine Erlaubnis zum Daueraufenthalt in der EU die einzige Möglichkeit. Seit 2018 verlangt Polen von Migrierenden, die dies beantragen, ein staatliches Zertifikat über die Polnischkenntnisse. Experten kritisierten die Änderung: Die Prüfung wird nur von einigen wenigen Zentren durchgeführt, die vom Ministerium für Inneres und Verwaltung anerkannt sind (derzeit sind 44 Zentren im ganzen Land anerkannt, aber nur 29 führen die Prüfungen aktuell durch); Ausländer, die in Berufen arbeiten, die keine hohen Qualifikationen erfordern, haben nur sehr begrenzte Möglichkeiten, die Sprache zu lernen; zudem bedeutet die Erlangung des Status als Einwohner nicht zwangsläufig den Erwerb politischer Rechte.
Zu Beginn beantragten nur ein paar Tausend Menschen pro Jahr den Aufenthaltsstatus, da sie neben Sprachkenntnissen fünf Jahre ununterbrochene Steuer- und Sozialversicherungszahlungen nachweisen mussten. Es war jedoch absehbar, dass nach dem Anstieg der Zuwanderung aus der Ukraine in den Jahren 2014 und 2015 und Anfang der 2020er-Jahre zehntausende Menschen pro Jahr den Aufenthaltsstatus beantragen würden. Die Prüfung für das Sprachzertifikat findet jedoch nur viermal im Jahr statt, und eine Einrichtung kann nur etwa 100 Personen prüfen. Das zeigt, dass die Situation schon vor Covid-19 alles andere als rosig war.
Seit März letzten Jahres ist die Situation jedoch zu einer absoluten Katastrophe geworden: Die Sprachprüfungen, die im Juni 2020 stattfinden sollten, wurden abgesagt. Die Prüfungen im Oktober wurde nur in einer Handvoll Einrichtungen abgehalten, weil zwei Tage vor Prüfungsbeginn das ganze Land zur roten Zone erklärt wurde und das Ministerium nicht rechtzeitig offiziell feststellen konnte, ob eine Sprachprüfung als öffentliche Versammlung zähle [öffentliche Versammlungen sind in den roten Zonen verboten, Anm. d. Red].
<h3>Steuern zahlen – auch wenn man nicht arbeitet</h3>
Die Prüfung ist daher zu einem knappen Gut geworden: Ausländer haben oft keine andere Wahl, als die Prüfung an weit entfernten Orten abzulegen. Manche erfuhren im Oktober erst auf dem Weg zum Prüfungszentrum, nachdem sie Hunderte von Kilometern zurückgelegt hatten, dass die Prüfung abgesagt wurde. Andere hatten Glück: Ihre Reservierungen wurden auf die nächste Sitzung verschoben; in manchen Fällen wurden sie aber einfach ganz abgesagt. Nicht nur kostete es die Prüflinge viel Zeit und Geld, sie standen auch unter einem emotionalen Druck.
Das Belastendste an all dem ist die Ungewissheit: Wann, wenn nicht jetzt, werde ich mich darum kümmern können? Wie lange werde ich in dem Land, das bereits zu meiner Heimat geworden ist, mit einem temporären Status leben, ohne jegliche Sozialhilfe oder das einfache Recht, mich arbeitslos zu melden?
Es war in letzter Zeit auch nicht einfach, Geld zu erhalten. Besonders für diejenigen, die im Gastgewerbe oder in Sportzentren arbeiten, wo ein großer Prozentsatz der Migrierenden in Polen tätig ist. Viele von ihnen sind seit einem Jahr arbeitslos, zahlen aber weiterhin Sozialversicherungsbeiträge, um ihre "Bilanz" für den Antrag auf einen Aufenthaltsstatus nicht zu verderben. Polen hat allen Einwanderern erlaubt, für die Dauer der Pandemie im Land zu bleiben, und der Verlust der Arbeit führt nicht mehr zur Abschiebung, schließt aber immer noch die Möglichkeit einer langfristigen Aufenthaltsgenehmigung aus. Also wieder: Warten und Unsicherheit.
Im Übrigen kostet die Prüfung selbst 170 Euro und zusätzlich eine Gebühr für Vermittler anfällt: Wenn mehrere Tausend Menschen auf der Jagd nach einigen hundert Plätzen sind, haben nur die "Findigsten" eine Chance.
Auch die Situation in den Prüfungszentren sollte an dieser Stelle erwähnt werden: Hygieneregeln verpflichten sie, zusätzliches Personal einzustellen (für Reinigung, Desinfektion, Garderobe) und zusätzliche Räume anzumieten. Und wenn die Prüfung kurz vor knapp abgesagt wird, trägt das Zentrum die Kosten, nicht der Staat. Die Mitarbeitenden der Zentren erhalten verzweifelte Anrufe und hören Geschichten darüber, dass jemand die Prüfung nicht zum vierten Mal ablegen kann, dass er oder sie wieder eine befristete Aufenthaltsgenehmigung beantragen muss, dass er oder sie wieder jahrelang warten muss, und dass es immer so weitergehen wird.
<h3>Es geht um Vertrauen</h3>
Die Prüfungen im Januar wurde in einer entspannteren Atmosphäre abgehalten. Die nächste Prüfung war für den 27. und 28. März geplant, aber am Abend des 19. März wurde angekündigt, dass die Prüfung nicht stattfinden wird (der Koordinator eines der Zentren ist Mitglied der staatlichen Zertifizierungskommission). Angeblich (!) wurde sie auf Anfang Mai verschoben.
Obwohl die Regierungsverordnung vom 19. März 2021 ausdrücklich zulässt, dass die Prüfung auch im Lockdown stattfinden kann, wurde die Genehmigung von der Staatlichen Kommission für die Zertifizierung von Polnischkenntnissen anderthalb Stunden nach der Veröffentlichung der neuen Regierungsverordnung und eine Woche vor der Prüfung zurückgezogen. Die Ankündigung steht immer noch auf der Website der Kommission, aber viele Zentren haben immer noch keine offizielle E-Mail-Adresse oder Telefonnummer, um wichtige Information zu erhalten. Die Leute haben bereits für ihre Prüfungen, Tickets und gemieteten Wohnungen bezahlt, aber das kümmert niemanden.
Es muss betont werden, dass in der aktuellen Situation nicht nur "gewöhnliche Migranten" leiden, sondern auch die Lieblinge der polnischen Migrationspolitik: die Inhaber der Karta Polaka. Ohne ein Sprachzertifikat können sie die Staatsbürgerschaft nicht beantragen. Das wiederum macht es unmöglich, in bestimmten Berufen zu arbeiten, einen Job in einem anderen EU-Land anzunehmen oder &nbsp;ohne Gerichtsverfahren einen polnischen Staatsbürger zu heiraten.
Dass die Prüfung für Migrierenden ein Problem ist, ist der polnischen Verwaltung gut bekannt. Letztes Jahr wurde dieses Thema von NGOs diskutiert und der Ombudsmann legte diesbezüglich Beschwerde ein. Leider hat dies die staatliche Verwaltung nicht für die Probleme derjenigen sensibilisiert, die weniger Rechte, aber mehr Pflichten haben. Und nun leiden sie zusätzlich unter der Unsicherheit der Pandemie. Dies ist ein weiteres Beispiel dafür, wie der polnische Staat mit Migrierenden umgeht: Sie sollen arbeiten, Steuern und Sozialversicherung zahlen, ihre Ersparnisse anlegen, aber der Staat tut nichts für sie. Und selbst wenn Forderungen an sie gestellt werden, haben sie eventuell später keine Möglichkeit, diese zu erfüllen.
Zu Beginn des ersten Jahrzehnts dieses Jahrhunderts betonte Polen, dass es keine Einwanderer brauche. Das Gegenteil war der Fall: Die hohe Arbeitslosigkeit zwang die Polen, sich im Westen nach Arbeit umzusehen. Weniger als ein Jahrzehnt später wurde jedoch offensichtlich, dass die polnische Wirtschaft nach der Massenabwanderung von Bürgern nach Großbritannien und Skandinavien immer noch zumindest saisonale Arbeitskräfte aus dem Ausland benötigt. Heute besteht aufgrund der Demografie kein Zweifel mehr: Eine langfristige Zuwanderung von mindestens mehreren Millionen Menschen ist im Interesse Polens.
Im Jahr 2020 starben in Polen mehr als 476.000 Menschen, so viele wie noch nie seit dem Zweiten Weltkrieg, und etwa 355.000 Menschen wurden geboren, die niedrigste Zahl seit mehreren Jahren. Im Laufe der letzten zwölf Monate ist das Land um 120.000 Menschen geschrumpft. Alles deutet darauf hin, dass sich die Situation in den kommenden Jahren nur noch verschlimmern wird. Gleichzeitig hat Polen jedoch seit fünf Jahren keine Migrationspolitik mehr.
Die oben beschriebene Situation mit den Prüfungen führt dazu, dass zahlreiche Migranten das Vertrauen in den polnischen Staat verlieren. Und dann kommt die Frage auf: Was unterscheidet Polen wirklich noch von meinem Heimatland, der Ukraine?
